Plain-Language Summary
Before you read the full legal text below, here is what you need to know in simple terms:
- NativeSwap is an interface, not a custodian. We never hold, control, or have access to your funds. Your wallet, your keys, your responsibility.
- You choose the protocol. When you swap, you select which third-party protocol (e.g., THORChain, Maya Protocol, Chainflip, Near Intents, etc.) processes your transaction. We simply relay your request. If that protocol loses, delays, or mishandles your funds, that is between you and the protocol - we bear zero liability.
- Our only responsibility is to accurately broadcast the transaction details you confirm - meaning the correct amount, the correct destination address, and the correct memo/data as specified by the protocol. If we make an error in that broadcast step (e.g., sending a different amount or address than what the protocol instructed), we will work to make it right.
1. Introduction
Welcome to NativeSwap. These Terms of Service ("Terms") govern your use of the NativeSwap website, interface, and related services (collectively, the "Services") operated by NativeSwap ("we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you must stop using the Services immediately.
2. Definitions
"Digital Assets" means blockchain-based tokens, cryptocurrencies, or other digital assets.
"Protocol" means any third-party decentralized protocol, liquidity network, or smart contract system (e.g., THORChain, Maya Protocol, Chainflip, Near Intents, or any other protocol integrated into the Services) that processes cross-chain swaps or transactions.
"Interface" means the NativeSwap front-end application that allows you to interact with Protocols.
"Transaction Broadcast" means the act of submitting a transaction on your behalf to a blockchain network or Protocol, using the parameters (amount, destination address, memo/data) specified by the Protocol and confirmed by you.
"User" means any individual who accesses or uses the Services.
3. Nature of the Services - Interface Only
NativeSwap is a user interface only. We provide a front-end that allows you to interact with third-party decentralized Protocols. We want to be absolutely clear:
- We do not hold, custody, control, or have access to your Digital Assets at any time.
- We do not operate any liquidity pools, vaults, smart contracts, or blockchain validators.
- We do not execute swaps - the Protocols you choose do.
- We do not guarantee any swap rate, completion time, or outcome.
- We are not a broker, dealer, exchange, custodian, or financial institution.
Your funds move directly from your wallet to the Protocol you select. At no point do your funds pass through any wallet, server, or account controlled by NativeSwap.
4. Eligibility
To use the Services, you must be at least 18 years old and have the legal capacity to enter into these Terms in your jurisdiction.
You may not use the Services if you are located in, or a citizen or resident of, any jurisdiction where your use would be illegal or would violate any applicable law, including sanctions regulations.
5. Wallet Connection & Self-Custody
The Services do not require account registration. To use swap functionality, you connect your own self-custodial wallet. You are the sole owner and controller of that wallet and all assets within it.
We never have access to your private keys, seed phrases, or wallet credentials. You are solely responsible for maintaining the security of your wallet.
6. Your Responsibilities
By using the Services, you accept full responsibility for:
- The security of your wallet, private keys, and seed phrases
- Choosing which Protocol to use for your swap
- Verifying all transaction details (amounts, addresses, network) before confirming
- Understanding the risks of the Protocol you select, including but not limited to smart contract bugs, liquidity issues, slippage, and network congestion
- Determining and complying with all tax obligations related to your transactions
- Ensuring your use of the Services complies with all laws applicable to you
7. Protocol Risk & Zero Liability for Protocol Failures
This is the most important section of these Terms. Please read it carefully.
When you use NativeSwap to perform a swap, you choose which third-party Protocol will process the transaction. NativeSwap simply relays your transaction to that Protocol. We have absolutely no control over what happens once the Protocol receives your transaction.
NativeSwap bears ZERO liability for any loss, delay, or mishandling of your funds by any Protocol. This includes, without limitation:
- Funds lost due to Protocol smart contract bugs, exploits, or hacks
- Funds stuck or delayed due to Protocol outages, halted chains, or network congestion
- Funds lost due to Protocol insolvency, rug pulls, or governance failures
- Unfavorable swap rates, excessive slippage, or front-running by MEV bots on the Protocol
- Partial fills, failed transactions, or refund failures by the Protocol
- Any other loss arising from the Protocol's operation, regardless of cause
You assume all risk when selecting and using a Protocol. You acknowledge that cross-chain swaps involve complex, experimental technology and that total loss of funds is possible. If you experience issues with a Protocol, your recourse is with that Protocol's team or community - not with NativeSwap.
8. Our Limited Responsibility - Transaction Broadcasting Only
NativeSwap's sole technical responsibility is to accurately broadcast transactions according to the parameters specified by the Protocol and confirmed by you. Specifically, we are responsible for ensuring that:
- The amount sent matches the amount you confirmed and the Protocol specified
- The destination address matches the address provided by the Protocol
- The memo or transaction data matches what the Protocol requires
If NativeSwap makes a verifiable error in the Transaction Broadcast - for example, broadcasting a different amount than the Protocol specified, or sending funds to an incorrect address due to a bug in our interface - we will make commercially reasonable efforts to rectify the error or compensate for the loss, up to the value of the affected transaction.
This is the only circumstance under which NativeSwap accepts any liability. For absolute clarity: if the Protocol itself misroutes, loses, or fails to process your funds after receiving a correctly broadcast transaction, that is not our responsibility.
9. Digital Asset Risks
By using the Services, you acknowledge and accept that:
- Digital Asset prices are highly volatile - you could lose some or all of your assets
- Cross-chain swaps involve experimental technology with inherent risks
- Blockchain transactions are irreversible once confirmed
- We do not provide investment, financial, tax, or legal advice
- Past performance of any Digital Asset does not guarantee future results
- Regulatory changes could affect the legality or availability of certain Digital Assets
10. Fees
NativeSwap may charge a service fee on certain transactions. Current fees are displayed in the interface before you confirm a swap. We reserve the right to change fees at any time.
You are also subject to blockchain network fees (gas fees) and any fees charged by the Protocol you select. These fees are not set or collected by NativeSwap.
11. Prohibited Activities
You agree not to:
- Use the Services for any illegal purpose or to violate any applicable law
- Use the Services to launder money, finance terrorism, or evade sanctions
- Attempt to interfere with, compromise, or disrupt the Services
- Use automated tools (bots, scrapers, crawlers) to access the Services without permission
- Introduce viruses, malware, or other harmful code
- Attempt to bypass security measures or access restrictions
- Impersonate any person or entity
12. Third-Party Protocols and Services
The Services integrate with and display information from third-party Protocols and services. We do not control, endorse, or assume responsibility for any third-party Protocol, service, or content. The inclusion of any Protocol in our interface does not constitute an endorsement or recommendation.
You are solely responsible for evaluating the trustworthiness, security, and reliability of any Protocol you choose to interact with through our interface.
13. Intellectual Property
The NativeSwap interface, its design, code, and branding are the property of NativeSwap and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our interface without prior written consent.
14. Privacy
Our Privacy Policy explains how we handle your information. By using the Services, you agree to our Privacy Policy. As a non-custodial interface, we collect minimal data - primarily what is necessary to operate the interface and improve the user experience.
15. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION DISPLAYED, INCLUDING SWAP QUOTES, TOKEN PRICES, OR PROTOCOL STATUS.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIVESWAP SHALL HAVE ZERO LIABILITY FOR ANY LOSS OF DIGITAL ASSETS, PROFITS, DATA, OR OTHER DAMAGES ARISING FROM:
- YOUR USE OF OR INABILITY TO USE ANY THIRD-PARTY PROTOCOL
- ANY ACTION OR INACTION BY ANY PROTOCOL, LIQUIDITY PROVIDER, OR BLOCKCHAIN NETWORK
- SMART CONTRACT BUGS, EXPLOITS, OR FAILURES IN ANY PROTOCOL
- PRICE VOLATILITY, SLIPPAGE, OR UNFAVORABLE SWAP RATES
- YOUR FAILURE TO SECURE YOUR WALLET, PRIVATE KEYS, OR SEED PHRASES
- REGULATORY ACTIONS OR CHANGES IN LAW
- HACKING, PHISHING, OR UNAUTHORIZED ACCESS TO YOUR WALLET
- ANY CAUSE BEYOND OUR DIRECT CONTROL
OUR SOLE LIABILITY, AS DESCRIBED IN SECTION 8, IS LIMITED TO VERIFIABLE ERRORS IN TRANSACTION BROADCASTING. IN ALL CASES, OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF (A) THE VALUE OF THE SPECIFIC AFFECTED TRANSACTION, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
17. Indemnification
You agree to indemnify and hold harmless NativeSwap, its operators, affiliates, and service providers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your interaction with any Protocol.
18. Dispute Resolution
Any dispute arising from these Terms or your use of the Services shall be resolved through good-faith negotiation first. If negotiation fails, the dispute shall be settled by binding arbitration conducted online in English, under internationally recognized arbitration rules. Each party bears its own costs.
You agree to bring any claim individually and not as part of a class action or representative proceeding.
19. Changes to Terms
We may update these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
20. Termination
We may restrict or terminate your access to the Services at any time, for any reason, without notice. All provisions that should survive termination (including liability limitations, disclaimers, and indemnification) shall survive.
21. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NativeSwap regarding the Services.
